HYDRO-BLOK SHOWER SYSTEM Limited LIFETIME Warranty – Revised January 2021

LIMITED WARRANTY COVERAGE:

Subject to the conditions and limitations as stated below, Hydroblok Grand International Inc. & Hydro-Blok Canada Inc. (“Hydro-Blok”) warrants that all its foam based products, drain products and sealant products will be free from all manufacturing defects, and will not deteriorate or break down under normal use for THE LIFETIME OF THE PRODUCTS from the date of purchase when the product is used and installed in accordance with the written specifications of Hydro-Blok’s technical data sheets, instructions and industry standard guidelines. Owner must complete and submit the Registration to Hydro-Blok, available at www.hydroblok.com, or submit proof of purchase and installation information (including installation date, installer’s name and address) to Hydro-Blok at the address provided hereafter within sixty (60) days of installation.

EXCLUSIVE RESOLUTION:

If the Product is installed as a system and fails to meet this warranty, then the owner’s exclusive remedy and the sole obligation of Hydro-book is to pay for the replacement of its own products and replacement of finishing materials, along with replacement installation. Hydro-Blok will not pay more for the replacement, calculated on a square foot basis, than the original purchase price of the portion being replaced. Hydro-Blok will not pay for replacement of any portion of the installation that is not proven to be defective. Efflorescence is something that comes from cement-based materials and is not considered as a defective condition and therefore not covered by this warranty.

DISCLAIMER:

There are no warranties beyond this expressed warranty as stated above. All other warranties, representations or conditions, expressed or implied, are disclaimed and excluded, including warranties, representations or conditions of merchantability or fitness for a particular purpose arising by statue or otherwise by law or from a course of dealing or usage of trade. This warranty is given in lieu of any other warranty expressed or implied. The remedies contained herein are the only remedies available for breach of this warranty. This limited warranty gives you specific legal rights. Some Provinces and States do not allow disclaimers or other restrictions of implied warranties, so some of the above disclaimers may not apply to you.

EXCLUSIONS:

Hydro-Blok will only warrant the original purchaser or owner and does not allow this limited warranty to be transferred or assigned to a new end user or owner. Hydro-Blok is not responsible for any workmanship that is not in accordance with the installation instructions provided by Hydro-Blok. and industry building standard guidelines. Hydro-Blok shall have no liability in the event of lost profits, any losses due to delays, or any other incidental or consequential damages arising from the following list:

a) Damages coming from anything connected to the product or materials of which it is part
b) Any intentional or unintentional penetration or destruction of the system
c) Damages from excessive structural movement or deflection
d) Acts of God, war or terrorism
e) Fire and explosions
f) Any and all misuse of the products at any time during the installation process
g) Any exterior, industrial or submerged installations or applications.

HOW TO MAKE A CLAIM:

To make a claim under this Limited Lifetime Warranty, the original purchaser or owner must notify Hydro-Blok. by email to sales@hydroblok.com within 30 days of any concerns or issues of a manufacturing defect. With the written notice, the end user must also provide the original proof of purchase complete with date and all products purchased, and all costs involved with installation. Hydro-Blok. reserves the right to inspect the original installation and/or request photographic evidence as a condition of this limited warranty in order to substantiate each claim.

This Limited Lifetime Warranty is governed by the laws of the State of Nevada in the US and the Province of Ontario in Canada. Any warranty claims will be approved and provided by Hydroblok Grand International Inc. warranty claims department only.
